ENERLIX.com Terms and Conditions (including privacy)
I Preface
ENERLIX.com is an enterprise of the Bascotec Internet Ltd., Technologiepark 13, 33100 Paderborn, Germany.
These terms and conditions describe the relation between ENERLIX.com and its registered users. The services provided by ENERLIX.com are catering to the international business to business sector.
II Obligations of the User
The user of ENERLIX.com is responsible for the truthfulness of all her provided data, content and personal information and for the confidential handling of all her passwords and login informations. The user is also responsible that the content and the conduct of business through any of the ENERLIX.com services are in agreement with international and German laws and the laws and regulations of the users country. The user is aware that ENERLIX.com is an international marketplace and thus publishing the users company profiles, advertisements and other provided informations worldwide.
III Obligations of ENERLIX.com
ENERLIX.com is providing a broad variety of services for international business. ENERLIX.com has the right to verify registrations or to reject services in case of contract disputes, misconduct or any kind of illegal activity by the user. Any such rejection is at the discretion of ENERLIX.com
IV Cost of Services
At this point all ENERLIX.com services are free of charge. When purchasable services are added the user will be informed accordingly and can order those services separately. All purchasable services will end automatically with the end of the payment period, there will be no automated contract extension by ENERLIX.com. If a chargeable service expires all free services will be continued for the user.
V Contract, Duration and Termination
This contract is being upheld as long as the user has data uploaded on ENERLIX.com or uses services provided by ENERLIX.com and ends when either the user or ENERLIX.com terminates the use of those. In case of purchased services the contract ends with the end of the payment period. ENERLIX.com has the right to publish all user provided information and content on the ENERLIX.com network and affiliated sites.
VI Accountability
There may be interruptions of service due to technical or other kinds of problems including force majeure for which ENERLIX.com can not be hold accountable. ENERLIX.com is not liable for any loss of data and can not guarantee the completeness or accuracy of the provided content. There may be links on ENERLIX.com to external websites that are not part of the ENERLIX.com network, ENERLIX.com is also not liable for content or any information given on those sites. The use of services on ENERLIX.com is at the risk of the user. Furthermore, ENERLIX.com may make claims against the user in case of damaging misconduct or illegal behaviour.
Please note that ENERLIX.com is in the beta phase and all of the services are subject to ongoing changes and optimizations.
VII Privacy
(1) ENERLIX.com is bound to strict German and international privacy laws. To use the services the user agrees to the processing, storage and use of her data within the ENERLIX.com network and affiliated sites. ENERLIX.com is also logging all user IPs to prevent and track any kind of misuse of the services. To optimize customer support ENERLIX.com is also logging any activity of the user in the secured administration area of the website.
(2) Please note that ENERLIX.com uses Google Analytics which is a service provided by the Google Inc. Google Inc. may safe files (“cookies”) on the users system and also track the users IP to analyse her use of the internet and of the ENERLIX.com website. The user can block cookies but that may also prevent ENERLIX.com services to work properly. If you do not agree to the Google Inc. privacy policies please do not register on ENERLIX.com. (3) Please note that the Bascotec Internet Limited may have other affiliated companies of the company network, such as the oak media GmbH (Germany), perform any or all of the ENERLIX.com services.
(4) For a personalized registry on ENERLIX.com and a distinct user identity it is required that the user provides a login/user name, a valid email, details about the users company or institution and the users IP. ENERLIX.com is taking all appropriate measures that any non public informations stay confidential. The user can change her personal information at any time by altering her profile. Also if the user does wish so more detailed personal informations can be displayed in the marketplace.
VIII Technical Mails
To be able to provide the described services and for mutual legal validation of these terms and conditions ENERLIX.com has to send emails with technical informations about the website. These emails do not include any kind of advertisement. If you do not agree to receiving such emails, please do not register on ENERLIX.com.
IX Final Provisions
Jurisdiction is with the German law and the courts in Paderborn, Germany.
If any provisions of these terms and conditions have gaps or become obsolete because they are in disagreement with any national or international law then all other provisions do not become obsolete as well but the obsolete provision is being replaced by the legal provision that is closest to the intend of these terms and conditions and in the common interest of the contracting parties.
